By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use our Services.

You acknowledge that you have read, understood, and agree to be bound by these Terms, which may be updated by us from time to time. We will notify you of any material changes by posting the new Terms on our website and/or by other reasonable means. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms.

TalentAI (a product of DokimAI) provides a Software as a Service (SaaS) platform offering asynchronous video interviewing, candidate screen recording, and automated AI evaluation services.

Our Services include, but are not limited to:

• Setting up custom campaign pipelines and candidate question sets.
• Providing responsive screen recording and webcam capture views for candidates.
• Generating performance feedback summaries, transcriptions, and competency analytics powered by Artificial Intelligence (AI).
• Offering customized candidate evaluation cards and rating workflows.

• Eligibility: You must be at least 16 years old to use our Services. By using the Services, you represent and warrant that you meet this requirement.
• Account Registration: To access certain dashboard and campaign creation features, you will be required to register for an account. You agree to provide accurate, current, and complete information and keep it updated.
• Account Security: You are responsible for maintaining the confidentiality of your account login information (username and password) and for all activities under your account. You agree to notify us immediately of any unauthorized use or security breaches.

• Permitted Use: You may use the Services solely for recruiting purposes or completing video interviews as a candidate, in accordance with these Terms.
• Prohibited Conduct: You agree not to:
  • Use the Services for any illegal, deceitful, or unauthorized purpose.
  • Interfere with or disrupt the integrity, networks, or servers of the Services.
  • Decompile, disassemble, or reverse engineer any part of the candidate recording or evaluation systems.
  • Use automated scripts, scrapers, or tools to harvest data from campaign dashboards.
  • Upload or transmit materials containing malicious code, viruses, or Trojan horses.
  • Attempt to cheat or bypass webcam/screen verification during live candidate sessions.
• Accuracy of AI Evaluation Content: While our AI models aim to provide high-quality, relevant transcription and grading metrics based on candidate responses, we do not guarantee the absolute accuracy, completeness, or suitability of AI insights for hiring decisions. Evaluation cards and summaries are provided as assistance tools for hiring managers and should not be treated as a substitute for human review.

• Our IP: All intellectual property rights in and to the Services (including but not limited to the dashboard designs, video players, assessment interfaces, layouts, logos, and the AI models/prompts used to analyze candidate recordings) are owned by DokimAI or its licensors.
• Your Data: You retain ownership of the candidate information, job descriptions, and video/audio interview recordings you upload or record. You grant DokimAI a worldwide, non-exclusive, royalty-free license to host, transmit, and process Your Data solely to provide and improve the services, and to refine our AI models in an aggregated, anonymized form.
• Generated Materials: Evaluation summary cards and performance reports are generated based on your input. Any commercial resale or public distribution of TalentAI's platform assets without our express written consent is prohibited.

• Pricing: Access to campaign creation, recruiter workspaces, and larger limits on video recordings require subscription or pay-as-you-go fees, as stated on our pricing pages.
• Payment Processing: Fees are billed in US Dollars. We utilize third-party payment gateways (e.g., Paddle/Stripe) to securely process payments. By upgrading, you agree to their respective terms.
• Refunds: Refund requests are analyzed on a case-by-case basis at our sole discretion.

Your privacy and the security of candidate data are critical to us. Please refer to our Privacy Policy Page to understand how we collect, process, and protect video recordings and candidate profiles under GDPR rules. By agreeing to these Terms, you also consent to our data practices.

NO WARRANTY: THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. DOKIMAI DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

AI EVALUATIONS: WE DO NOT WARRANT THAT THE AI EVALUATIONS WILL BE ENTIRELY BIAS-FREE, ACCURATE, OR ERROR-FREE. THE FINAL DECISION TO SELECT OR REJECT A CANDIDATE RESTS SOLELY WITH THE RECRUITER OR CLIENT ORGANIZATION. YOU ACKNOWLEDGE THAT ALL USE OF AI METRICS IS AT YOUR SOLE RISK.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DOKIMAI, ITS AFFILIATES, DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENATAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL) ARISING OUT OF THE USE OF OR INABILITY TO USE THE VIDEO INTERVIEW PLATFORM.

IN NO EVENT SHALL DOKIMAI'S TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT PAID BY YOU TO DOKIMAI FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless DokimAI and its affiliates, officers, directors, and employees from any claims, liabilities, losses, costs, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, misuse of the candidate evaluation features, or infringement of candidate privacy rights.

We reserve the right to suspend or terminate your access to TalentAI at any time, with or without notice, if we believe you have breached these Terms or violated recruiting compliance laws. Upon termination, your right to use the dashboard and campaign tools will cease immediately.

• Governing Law: These Terms shall be governed by and construed in accordance with the laws of Georgia, without regard to its conflict of law principles.
• Arbitration: Any dispute arising out of these Terms shall be settled by arbitration in Tbilisi, Georgia, in the English language, by a single arbitrator.
• Class Action Waiver: You agree that any dispute resolution proceedings will be conducted solely on an individual basis and not as a class or representative action.

• Entire Agreement: These Terms, alongside the Privacy Policy, represent the complete agreement between you and us regarding TalentAI.
• Severability: If any provision is deemed invalid or unenforceable, the remaining terms shall continue in full force.
